These Terms and Conditions (the “Agreement”) apply when you use the Eatbay website and mobile application (“Eatbay Platform”) to purchase items from restaurants (“Restaurants”). By using the Eatbay Platform, you agree to the terms set forth in this Agreement, which governs your purchase and use of goods and services via Eatbay.

Terms of Purchase

To use the Eatbay Platform, you must ensure that you have a functioning device with internet access. Upon compliance with this requirement, the Eatbay Platform enables you to view items for sale, purchase items, and track orders. By placing an order, you are agreeing to the terms outlined herein.

When you purchase an item through the Eatbay Platform, payment will be processed through secure external payment gateways, including credit/debit card, Apple Pay, Google Pay, or PayPal. Cash on delivery may be available under certain circumstances and can be withdrawn at any time. By submitting payment, you authorize Eatbay to take payment for the goods when they are dispatched to you. You must ensure that your payment details are accurate and up-to-date.

Payment & Delivery Process

You are required to register on the Eatbay Platform to access its services, entering your payment details for item purchases. Your payment details will be securely saved on an external PCI-certified server. You may need to display the order number to restaurant staff at the time of collection or delivery as proof of identification. It is your responsibility to safeguard your order number. Eatbay ensures that payment details are transmitted securely using SSL encryption, though transmission over the internet is not guaranteed to be 100% secure. Any misuse of payment information due to your failure to protect it will not be the responsibility of Eatbay.

For physical items such as food and beverages (“Tangible Items”), the service aims to deliver your order within reasonable timeframes. However, delivery times are estimates and should not be treated as guarantees.

EatBay Refund Policy

At EatBay, we operate as a platform that connects customers with restaurants. Please note that EatBay does not collect payments for orders placed through our platform. All financial transactions occur directly between the customer and the respective restaurant.

Refund Policy:

  • Once an order is placed, it is processed immediately by the restaurant. Therefore, cancellations and refunds cannot be issued under any circumstances.
  • Any disputes, including requests for refunds, must be resolved directly between the customer and the restaurant.
  • If the restaurant is willing and able to deliver the order, no refund will be provided.

For any concerns regarding order quality, service, or payment, please contact the restaurant directly. EatBay is not responsible for handling refunds or disputes. 

Intellectual Property

You acknowledge that any intellectual property rights, including trademarks, patents, designs, and copyrights related to the Eatbay Platform, including logos, branding, and the software, belong to Eatbay or its licensors. You do not acquire any rights or ownership to this intellectual property by using the Eatbay Platform.

Service Access

Eatbay aims to provide uninterrupted access to the Platform, but cannot guarantee continuous service. If there is any disruption in service, Eatbay will not be liable. You are responsible for maintaining the equipment and internet connection necessary to access the Platform. You must ensure that you have the appropriate permissions to use your device and download the Eatbay Platform.

Liability

Eatbay’s liability to you, whether in contract, tort, or otherwise, will not extend to loss of profits, goodwill, or consequential losses. However, Eatbay’s liability for any claim related to your order will not exceed the total price you paid for the items ordered.

Data Protection

Eatbay is committed to safeguarding your privacy and ensuring the security of your personal data. Any data we collect, including personal information such as name, address, email, phone number, and payment details, will be processed in accordance with our Privacy Policy, available on the Eatbay Platform.

Miscellaneous

Eatbay reserves the right to amend this Agreement at any time. Any changes will be posted on the Eatbay Platform, and by continuing to use the service, you accept these changes. If any provision of this Agreement is deemed unenforceable, the remainder will continue in full force and effect. This Agreement constitutes the entire understanding between you and Eatbay and supersedes any prior arrangements. The Agreement is governed by the laws of England and Wales.

Acceptance

By using the Eatbay Platform, you agree to be bound by the terms of this Agreement. Your continued use of the Platform constitutes your acceptance of these terms.
